General Information

On May 25, 2018 the European Union adopted the General Data Protection Regulation which has since been used to govern and regulate the collection and processing of personal data of individuals across all member states.

In its capacity of personal data administrator for provision of information services, BLD Mona EOOD is compliant with the stipulations of the new Regulation, collecting and processing data of individuals solely for the purpose of allowing normal access to, viewing and browsing of the website, for direct marketing purposes and stores them in a responsible and legal manner.

The information herein does not refer to links leading or redirecting to other websites from BLD Mona EOOD’s website – www.bldliving.com.

Any further changes to the Terms of this Privacy Notice will be timely published on this page. This allows you to stay informed on all issues regarding the way we collect, process and store personal data.

BLD Mona EOOD operates as a company in legal compliance with the Personal Data Protection Act and Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data.

Legal Basis for collection, processing and storage of your personal data

Art. 1. (1) BLD Mona EOOD collects and stores your personal data with regard to the normal accessing, viewing and browsing of the bldliving.com website and information services provided based on the stipulations of Art. 6, paragraph 1of the (EU) 2016/679 Regulation, namely on the basis of:

Your explicit consent as a customer;

(2) BLD Mona EOOD is a personal data controller with regard to your personal information as a user of our services. With regard to personal data processed on your part, using our website and enquiry form, BLD Mona acts as personal data processor.

Purposes and principles of personal data collection, processing and storage of your personal data

Art. 2. (1) BLD Mona EOOD collects and process your personal data, which you have provided with regard to accessing and browsing our website, including:

Statistical purposes;

Protection of information security;

Improving the functionality/operation of our website through extending offers or other interesting pieces of information we consider suitable to your needs.

(2) In accordance with its basic principles, followed by BLD Mona EOOD, your personal data is:

Processed in a fair, lawful and transparent manner;

Collected for explicit, specified legitimate and limited purposes;

Collected and processed in an adequate manner to secure a minimum data collection relevant to the purpose limitation;

Accurate and up-to-date;

Limited to storage for no longer than necessary for the purposes it has been collected for.

Processed in a manner that ensures protection and integrity to guarantee an appropriate level of personal information safekeeping.

(3) As part of the personal data processing and safekeeping procedure, BLD Mona EOOD can process and keep personal data in defence of its following legitimate interests:

Fulfilment of obligations to the National Income Agency, the Ministry of Internal Affairs and other state and municipal authorities.

What type of personal data is collected, processed and stored by BLD Mona EOOD?

Art. 3. (1) BLD Mona EOOD uses your personal information to conduct the following operations and respective purposes:

To send you an information message – the purpose of this operation is to administer the process of disseminating information and promotional messages to our clients.

To send you an information newsletter – the purpose of this operation is to administer the process of sending newsletters to our clients who have agreed explicitly that they would like to receive them.

(2) The following categories of personal data are subject to processing by BLD Mona EOOD with respect to the following purposes and legal grounds:  

Data: Your individual data (name, family name, email, country, phone number)

Personal data collection purpose: To connect with our clients and send them information, including, whenever explicit agreement is present – newsletters and promotional messages.

Legal grounds for personal data processing: Art. 6, paragraph 1, letter (b) of the GDPR, namely – on the basis of your explicit consent with regard to accessing, viewing and browsing our website, and/or on contacting BLD Mona EOOD.

Other personal data processed by BLD Mona EOOD – as soon as you have accessed our website or your account on our website, BLD Mona EOOD collects data on your IP address.

Personal data collection purpose: To improve the security level of our services, the interface localisation and for statistical and marketing research purposes.

Legal grounds for personal data processing: The act of processing is a necessary prerequisite for the execution of the legal relationship in which you as subject of personal data are a party to – Art. 6, paragraph 1, letter (b) of the GDPR.  The IP address is collected in execution of the legal interests of the administrator until an account is created by the user –  Art. 6, paragraph 1, letter (e) of the GDPR

Utilisation of additional applications (plugins) for social media

It is possible to have additional applications (“plugins”) of the social media platforms facebook.com and Twitter embedded in our web pages. The related services are then further provided by the two companies Facebook Inc.  and Twitter Inc. respectively, herein referred to as “suppliers).

Twitter is operated by Twitter Inc., 1355 Market St, Suite 900, San Francisco, CA 94103, USA. For further information on Twitter plugins, please visit: https://twitter.com/about/resources/buttons

In order to increase the protection of your personal data upon visiting our website, these plugins will be available in just two clicks. This ensures that when you access sites containing plugins via the BLD Mona EOOD website, you will not be automatically connected to the provider’s server. Only if you activate the plugins, thus allowing data transfer, the browser will connect you directly to the provider’s server. The content of the various plugins is then directly transferred from the provider to your browser and appears on your screen.

The plugin discloses information to the provider on our website pages that you have visited. If, while browsing our website, you happen to be logged into your Facebook or Twitter accounts, the provider will be able to compare your interests, for example – the information you are viewing with your account data. When you use any of these plugin functions (for example, click the “Like” button, leave a comment), this information will also be transmitted by the browser directly to the provider for storage.

To prevent Facebook or Twitter from associating your visit to our website with your user profile with these providers, you will need to stay logged out of your corresponding user profiles while accessing our pages.

(3) BLD Mona EOOD does not collect or process personal data related to the following:

Disclosure of racial or ethnic origin;

Disclosure of political, religious or philosophical beliefs, or membership in trade unions;

Genetic and biometric data, health data or data about sex life or sexual orientation.

(4) BLD Mona EOOD collects personal data from the natural persons to whom it relates.

(5) The company does not perform automated decision-making with data collected.

Personal data of children

BLD Mona EOOD does not wish to collect data from/on children under the age of 18. When sending us an inquiry, a confirmation that the person is 18 and over years old is agreed. If parents or other legal guardians find that children under their care have provided personal data to BLD Homes Ltd., we kindly ask that they contact us at the address below (see below) if they would like to have that data deleted. We will then arrange for this data to be deleted immediately.

Period of storage of your personal data

Art. 4. (1) BLD Mona EOOD stores your personal data for a period no longer than five years. After the expiration of this period, BLD Mona EOOD takes the necessary care to delete and destroy all your data, without unnecessary delay, in accordance with the accepted internal company procedure for the order of personal data erasure.

(2) BLD Mona EOOD notifies you in the event that the data storage period needs to be extended for the fulfilment of the outlined objectives, for contract fulfilment purposes and/or in view of legitimate interests of BLD Mona EOOD or otherwise.

(3) BLD Mona EOOD retains personal data that it is required to keep for the period outlined in accordance with applicable legal and regulatory requirements.

Transmission of your personal data for processing

Art. 5. (1) BLD Mona EOOD may, at its own discretion, transfer part or all of your personal data to personal data processors for the fulfilment of the purposes of processing in compliance with the requirements of Regulation (EU) 2016/679.

(2) BLD Mona EOOD will notify you if a case of  intention to transfer part or all of your personal data to third countries or international organisations should occur.

Your rights in the collection, processing and storage of your personal data

Withdrawal of consent to the processing of your personal data

Art. 6. (1) If you do not wish all or part of your personal data to continue to be processed by BLD Mona EOOD for specific or all processing purposes, you may at any time withdraw your consent to processing by sending as a written request.

(2) BLD Mona EOOD may request that you certify your identity and prove the identity of the person to whom the data refers.

Right to access your personal data

Art. 7. (1) You are entitled to the right to request and receive from BLD Homes EOOD a confirmation as to whether your personal data is being processed.

(2) You have the right to access the data related to your request, as well as the information related to the collection, processing and storage of your personal data.

(3) BLD Mona EOOD provides you, upon request, a copy of the processed personal data related to you, in an electronic or other appropriate form.

(4) Providing access to your personal data is free of charge, but BLD Mona EOOD reserves the right to charge an administrative fee in cases of repetitive or excessive requests.

Right to correction or completion of your personal data

Art. 8. You can correct or complete inaccurate or incomplete personal data related to you directly by sending a request to BLD Mona EOOD.

Right to erasure (“right to be forgotten”)

Art. 9. (1) You have the right to request from BLD Mona EOOD the erasure of your personal data, and BLD Mona EOOD has the obligation to delete it in a timely manner, should any of the following circumstances occur:

Your personal data are no longer necessary for the purposes they have been collected for or otherwise processed;

You withdraw your consent based on which your personal information is being processed and there is no other legal basis for their processing;

You object to the processing of your personal data, for direct marketing purposes including, and there are no overriding legal grounds for the processing;

Should the the personal data appear to have been processed unlawfully;

Your personal data must be deleted with regard to BLD Mona EOOD’s compliance with a legal obligation occurring under EU or other member state legislation.

(2) BLD Mona EOOD has no obligation to erase personal data when storing and  processing them with regard to the following circumstances:

To exercise the right to freedom of expression and the right to information;

To comply with a legal obligation that requires processing provided for/ in EU or member state legislation, applicable to the administrator, or for the performance of a task in public interest or in exercising official powers granted to the company in health-related public interest;

For the purposes of archiving and in public interest, for scientific or historical research or statistical purposes;

For the establishment and exercising of or in defending legal claims.

(3) In order to exercise your right to be “forgotten”, you should submit a written request to BLD Mona EOOD, as well as certify your identity and prove identity with the person to whom the data relates to before BLD Mona EOOD, by presenting your ID card for identification purposes to an employee of the company on site.

(4) BLD Mona EOOD does not delete personal data for which it has a legal obligation to store, including for protection, on the occasion of legal claims made against it or in proof of its rights.

Right to limitation

Art. 10. You have the right to demand from BLD Mona EOOD to limit the processing of the data related to you, in cases when:

You object the accuracy of the personal information, for a period that allows BLD Mona EOOD to verify the accuracy of the personal data;

The processing is illegal, but you do not want your personal data to be deleted, but only to have its use restricted;

BLD Mona EOOD no longer needs the personal data for the purposes of processing, but you require them in order to exercise or defend your legal claim;

You have objected to the processing and are awaiting pending verification of whether the legal grounds of BLD Mona EOOD take precedence over your interests.

Right to transfer

Art. 11. (1) You can at any time download the data that is stored and processed for you in connection with the use of the services of BLD Mona EOOD, directly through your profile or by e-mail request.

(2) You can submit a request to BLD Mona EOOD to directly transfer your personal data to an administrator specified by you, when this is technically feasible.

Right to receive information

Art. 12. You can ask BLD Mona EOOD to inform you about all recipients to whom the personal data for which correction, deletion or restriction of processing has been requested, has been disclosed to. BLD Mona EOOD may refuse to provide this information should it turn out to be impossible or require a disproportionately large effort.

Right to object

Art. 13. You can object at any time to the processing of your personal data by BLD Mona EOOD, including if it is being processed for direct marketing purposes.

Your rights in the event of a breach of  your personal data security

Art. 14. (1) Should BLD Mona EOOD detect a breach of the security of your personal data, which may create a high risk for your rights and freedoms, we shall notify you immediately of the breach, as well as of the measures taken or that  are yet to be undertaken.

(2) BLD Mona EOOD is not obliged to notify you in the following cases:

The company has undertaken appropriate technical and organisational measures to protect the data affected by the security breach;

The company has subsequently taken measures to ensure that the breach will not result in a high risk to your rights;

The act of notification should  require disproportionate efforts.

Disclosure to outsiders of personal data

Art. 15. Personal data collected from the site of BLD Mona EOOD is not disclosed to outsiders, not being part of the internal organisation of the administrator – BLD Mona EOOD. The persons who have the right to use the personal data within the organisation are comprehensively defined in the Rules and Regulations adopted for the internal order of the Company, as well as in the Procedures adopted for processing personal data.

Art. 16. The administrator does not transfer your data to third countries.

Art. 17. In the event of a violation of your rights under the above or applicable personal data protection legislation, you have the right to file a complaint with the Commission for Personal Data Protection as follows:

Art. 18. You can exercise all your rights regarding the protection of your personal data through the forms attached to the information herein. However, these forms are not mandatory and you can make your requests in any other form that provides for a statement made to that effect and identifies you as the data owner.

Art. 19. If the consent refers to a transfer, the administrator lists the possible risks relating to the transfer of data to third countries, in the absence of a decision for adequate protection and suitable means of protection.

Art. 20 (1). When you entrust BLD Mona EOOD to process personal data of a third party for the purposes of using the service, BLD Mona EOOD acts as a personal data processor.

(2). In the cases under paragraph (1), BLD Mona EOOD acts solely on your instructions as a user of the service and only to the extent that it can have control over the personal data that you process. BLD Mona EOOD has no control over the content and data that you, as a user of the service, choose to upload to the service (including whether or not this data includes personal data). In this case, BLD Mona EOOD has no role in the process of deciding whether the user uses the service for processing personal data, for what purposes and whether they are protected.

Accordingly, the responsibility of BLD Mona EOOD in this case is limited to 1) complying with the instructions of the service user according to the contract and general terms and 2) providing information about the service and functionalities through its interface.
